Cleared by a Kiss: French Olympian Ysaora Thibus Wins Doping Appeal with Unusual Defense

  • Ysaora Thibus tested positive for ostarine before the 2024 Olympics but was cleared by CAS.
  • Her defense linked the result to kissing her then-partner, who was unknowingly taking the banned substance.
  • The ruling dismissed WADA’s appeal and reinforced scientific consideration in doping cases.

French Olympic fencer Ysaora Thibus has been exonerated in a rare and controversial doping case after the Court of Arbitration for Sport (CAS) accepted that her positive test for ostarine was likely due to kissing her then-boyfriend, U.S. fencer Race Imboden.

The ruling comes after the World Anti-Doping Agency (WADA) appealed a prior decision by the International Fencing Federation’s doping disciplinary tribunal, which had already cleared Thibus.

Kissing Controversy: Scientific Evidence Clears French Fencer in Doping Case

The CAS panel reviewed medical evidence and expert testimony confirming that ostarine can indeed be transmitted through saliva. Imboden had begun using a product containing ostarine on January 5, 2024, and close contact with Thibus during that nine-day period led to her unintentional exposure. Scientists demonstrated that trace amounts of the substance could accumulate in her system just from prolonged kissing.

This case mirrors a 2009 incident involving French tennis player Richard Gasquet, who was cleared after testing positive for cocaine and arguing that the source was a nightclub kiss. Both cases underline the importance of investigating the context surrounding doping violations rather than relying solely on test results. The CAS emphasized the need to examine intention and circumstance in borderline contamination cases.

The decision has reignited debate over how anti-doping agencies balance strict liability with individual context. While athletes are ultimately responsible for what enters their bodies, rare exceptions—like unintentional exposure—demand a more flexible legal framework. The Thibus case might push for refined policies that incorporate both science and fairness in anti-doping evaluations.

Thibus’ professionalism throughout the ordeal has been praised by the French sporting community. Her ability to maintain composure and continue competing, despite the cloud of suspicion, has reinforced her reputation not just as a world-class athlete, but as a figure of resilience in the face of adversity. Her case may now serve as a reference point for future rulings involving low-level contamination.

Ysaora Thibus’ vindication highlights the importance of science, fairness, and context in modern sports law, setting a unique precedent for doping investigations.
